Poesje tacked at the mark and bore off onto PC. Highfreuency tried to tack inside but collided before her tack was completed.
RE and Highfrequency both thought it should be 18 - I don\\\'t. I\\\'m just not sure that I was allowed to continue bearing off whilst HF was tacking.
Poesje protested and spun!
System Info:Poesje was given a pen at t=443 (RE:Rule 18 - Mark room (!!)). Poesje raised the P flag at=448. Poesje span at t=462.

Poesje, have you considered rule 15?
Also, does rule 18 apply to boats on opposite tacks?

I think when you enter in the mark area you have the room at mark rights, i think this action have the most priority, the boats in the back have to keep the space between the boat in front.

No I do not believe Rule 18 applies - we both enter 3 bl on different tacks.
I think this is the point that HF has not considered.
I sailed my PC as ROW boat exactly as I would have done if HF had not been there. There is a conflict between his obligation to keep clear while tacking and my obligation to allow him room. In the absence of Rule 14 I think that HF was barging into a gap that just wasn't there. I am far from sure whether he would have avoided the collision if I had just auto tacked. I think that if HF accepts rule 18 did not apply he would conclude that he should have followed me round not tried to cut inside.

When he has no rights to be there, I haven't seen he is there and Rule 14 is not being applied?

Rule 18 applies to boats on the same tack, WHEN IN THE ZONE. They don't have to enter the zone on the same tack.
Rule 11 ALWAYS applies, even when rule 18 applies, although rule 18 may allow the inside boat to take mark room, even when they are the windward boat.
Applicable rule:
Rule 13
Rule 15
Rule 16.1
Rule 18
Facts:
1. Peosje tacks from port on to starboard, and enters the zone on starboard tack.
2. Prior to Poesje reaching a CHC, HF tacks to remain clear of Peosje. Rule 15 applies to Peosje, and once he reaches a CHC he must initially give HF room to remain clear.
3. While HF is tacking, Peosje reaches a CHC and then turns down into HF while HF is subject to rule 13. Peosje is subject to rule 16.1, and he must give HF room to remain clear if he alters course while RoW boat.
4. Peosje collides with HF prior to HF reaching a CHC.
5. Peosje protests and subsequently spins to exonerate
Decision:
Peosje breaches rule 15 and rule 16.1 by failing to initially provide room for HF to remain clear when Poesje became the RoW boat, and by altering course to collide with HF while he was tacking.
Peosje breaches rules 15 and 16.1 but spins to exonerate.
Protest Dismissed
