Gavinbpk hails "Tack or Cross?" at 55
Treby hails "C" at 58 indicating "Cross" in conventonal sailxing.
Gavinbpk hails "TY" (Thank You) at 61 acknowledging Trebys "Cross"
Gavinbpk on port collides with Treby at 64
Gavinbpk flys flag and hails protest at 68
I am not sure how to classify this however I would initially resort to rule two. In a real situation hailing cross and then hitting the port boat would be an incredibly unsafe and unsportsmanlike move.
System Info:gavinbpk was given a pen at t=64 (RE:Rule 10 - Port-Starboard). gavinbpk raised the P flag at=67.

yes, r2, treby it wasn't the nicest thing to do. Especially since u indicated that you would let apple cross... thats mean..

The protest is for a possible breach of rule 2 - Fair sailing. Please have a look at the rule and have a read of this RYA web page about Rule 2 and Rule 69.

Exoneration is only given if a boat retires or spins at the time of the incident.

Treby has been online within the past 18hrs but does not seem to be interested in this protest or realise how serious it is.
A ruling will be made within the next 12hrs.

Treby has been online within the past 4 hours but has decided not to comment here, so we will make a ruling and close.
t=54.7 gavinbpk asks Treby whether he should tack of if he can cross ahead of Treby.
t=58.7 Treby says "c" which gavin and we can take as meaning gavin can "cross".
t=62.1 gavin says "ty which usually means "thank you", clearly in response to Treby's offer to allow gavin to cross ahead.
t=64.2 contact occurs and gavin breaks R10.

Facts:
gavin asks if he can cross ahead of Treby. Treby tells gavin to cross but does not duck to allow him to cross. gavin breaks R10.
Discussion:
Treby clearly agrees to allow gavin to cross ahead but does not allow him to do so. Not only is this unsporting but it is unsafe sailing. A boat cannot and should not say that another boat can do something and then sail on into a collision.
CASE 47
A boat that deliberately hails ‘Starboard’ when she knows she is on port tack
has not acted fairly, and has broken rule 2.
Much like Case 47 where it is wrong for a port tack boat to hail "starboard" which is a lie, Treby saying that he will allow gavin to pass ahead but then not allowing him to is also basically a lie. This then results in an unsafe situation where a collision occurs.
Decision:
Treby breaks R2 - unfair sailing, gets a DSQ and -300 points and a recommendation for 2 weeks Red Flag Guest Rights.
