YoungerGun vs. SGR (Tack) E1-euro_1339840826_Dublin2012_3II_Jun16 [4] Rule 13 2012/06/16 21:05 (11 Months, 1 Week ago)
IRL711 tacks onto starboard then SGR is to leeward of me then tacks I tack before he reaches CHC but still can not avoid contact.

System Info:YoungerGun was given a pen at t=66 (RE:Tack).    YoungerGun raised the P flag at=69.  YoungerGun span at t=80.

To start with, I don't understand why this is going to a protest. You transferred the penalty and i was forced to take a penalty turn.

Having a look at the facts in this situation:
1. SGR- the leeward boat, clear ahead of YoungerGun.
2. IRL711- starboard tack boat, ROR over both SGR & YoungerGun (R10).
3. As SGR was the leeward boat (whilst not overlapped) and first to come contact with IRL711, she must keep clear.
4. IRL711 tacked at a late enough stage to not give SGR time to make a hail (R20.1), which says 'when approaching an obstruction (in this case IRL711) a boat sailing close-hauled or above MAY hail for room to tack'. The word MAY means it is not a requirement (also stated in R20.3)
5. Under R20.2, SGR is exonerated from keeping clear of YoungerGun (R16).

Based on these facts, it is obvious that in fact YoungerGun was in the wrong. Forcing SGR to take the penalty by transferring it should mean she should be the disqualified boat. YoungerGun took a penalty at a later stage in the race, and based on R44.2, she did not complete her penalty 'as soon after the incident as possible'.

Sincerely,

SGR

I protested because you infringe rules.

For number 3: You did not have tack you could have ducked.
For number 4: Did you hail? IMO No
For number 5: You are not exonerated under rule 20.2 because you did not hail so still infringe rules.

That penalty turn I did SGR was for a completely different situation. So rule 44.2 has nothing to do with it.

As the ROW boat in this situation IT IS MY CHOICE as to whether i want to tack or duck IRL711.

It seems to me that you have misread a number of my points:

3: As the ROW boat in this situation IT IS MY CHOICE as to whether i want to tack or duck IRL711 (R19.2)
4: As I had written down, I DID NOT HAIL, as I did not have time.

This still seems to be a ridiculous protest. I took a penalty and it was in fact you that was in the wrong (which of course is a subjective thing, but seems that you cannot accept another opinion than your own).

Regards,

Hi SGR

Yes it is you choice to tack or duck. But when you tack you have to hail for room which you didn't.

This is the first number 3.

This is the second number 3.

They are completely different to each other!

it is ridiculous because i have done a penalty turn, so what is the point of this protest?

the only thing that can result from this this is you getting disqualified, if you're proven wrong

The thing is SGR I protest before you spun and it was a clear rule breach so I did not unprotest.

here is what i see,
at t:62 we can see that IRL711 is on a collision course with SGR and on starboard therefore SGR must tack to avoid, however YoungerGun is in the way which means under rule 20.1 SGR must hail to prompt younger gun that she must tack.
at t:63.9 SGR tacks without hailing
at t:65.9 SGR must give YoungerGun time and opputunity to tack as per rule 15
younger gun tacks to avoid SGR and there is contact at t:66.9

SGR breaks rule 20.1 and 15

Thank you TamL, just a few queries for you:

1. I completed a penalty as soon as i was clear of the other boats, so why is this protest taking place?

2. I didn't have enough time to hail- what would you suggest I do?

3. If the answer to query 2 was to duck, I would not have been able to, as another boat (kruizz) was there, so I couldn't have ducked IRL711 either?

Thanks,

SGR

Ok, hi SGR I know I am not TamL but I want to answer.

SGR Wrote:

I had to protest you for you to spin. You then spun but I did not unprotest as you infringe rules.

2. I didn't have enough time to hail- what would you suggest I do?
No you did not have time to hail, you could have pressed esc esc.

3. If the answer to query 2 was to duck, I would not have been able to, as another boat (kruizz) was there, so I couldn't have ducked IRL711 either?
You could have eased or press esc esc.

yea, as i know it i think you press the keys 1-1 ( so press 1 twice and it will say, "Room to Tack!" this protest is taking place because you obviously didnt know the rules in this situation however because you spun youngergun should have unprotested or not filed the protest

Hi TamL

May I ask why because he spun I should have unprotested or not filed?

Facts:
SGR tacks and acquires ROW.
SGR does not give Room to YoungerGun to keep clear so SGR breaks R15.
SGR spins to exonerate.

Decision:
SGR breaks R15 and spins to exonerate - protest dismissed.

SGR - if you don't have time to hail then you must duck or avoid the ROW boat (obstruction) as best you can without breaking any rules with other boats. Or plan ahead and not get into a "Coffin Corner" portr tack approach to the mark. You cannot just tack like you do here breaking R15. Also it might be wise for your friend djg not to say anything if he does not know what rules have been broken.
